Welcome to Coloring Books Maker ("Service", "we", "us", "our"), available at coloringbooksmaker.com. These Terms of Service ("Terms") govern your access to and use of our Service. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

The Service is operated by a sole trader (trabalhador independente) registered in Portugal, European Union. Contact: support@coloringbooksmaker.com.

1. The Service

Coloring Books Maker is an AI-powered tool that helps users generate coloring book illustrations and related content for personal or commercial use, including self-publishing. The Service uses third-party AI providers (currently Google Gemini API) to generate images based on your prompts.

We may add, change, or remove features at any time. We do our best to keep the Service available, but we do not guarantee uninterrupted or error-free operation.

2. Eligibility

You must be at least 18 years old to create an account. Users between 13 and 17 may use the Service only with verifiable consent from a parent or legal guardian, who accepts these Terms on their behalf. The Service is not intended for children under 13.

3. Account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@coloringbooksmaker.com if you suspect unauthorized access.

4. Subscriptions, Credits and Payment

4.1 Plans

We offer monthly subscription plans (currently $15, $39, and $79 per month) and one-time credit purchases. Current pricing and credit allowances are shown on our pricing page.

4.2 Monthly credits vs. extra credits

  • Monthly subscription credits reset at the start of each billing cycle and do not roll over. Unused monthly credits expire.
  • Extra credits purchased separately as one-time top-ups do not expire as long as your account remains active.

4.3 Billing

Payments are processed by Stripe. By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis until you cancel. Prices are shown in USD and may be subject to applicable taxes (such as Portuguese/EU VAT) depending on your location.

4.4 Cancellation

You can cancel your subscription at any time through the Stripe Customer Portal accessible from your account. Cancellation stops future renewals; your plan remains active until the end of the current billing period.

4.5 Refunds

  • Subscriptions: You may request a full refund within 14 days of your initial subscription purchase, provided you have not used the included credits. Once credits have been used, the subscription is considered performed and is non-refundable.
  • One-time credit purchases: Non-refundable once credits are used. Unused credit packs may be refunded within 14 days of purchase at our discretion.
  • This refund policy is offered in addition to, and does not limit, any statutory rights you have as a consumer under EU and Portuguese law.

4.6 Failed payments

If a payment fails, we may suspend access until the balance is settled.

5. Content and Intellectual Property

5.1 Your prompts

You retain ownership of the text prompts and inputs you submit.

5.2 Generated content

Subject to your compliance with these Terms and payment of applicable fees, we grant you a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish and sell the images generated through your account, including for commercial self-publishing.

5.3 No warranty of originality or non-infringement

AI-generated outputs may resemble existing works or be similar to outputs generated for other users. We do not guarantee that generated content is original, unique, or free of third-party rights. You are solely responsible for:

  • verifying that your use of the content does not infringe any copyright, trademark, publicity, or other rights;
  • complying with the rules of any platform where you publish or sell (for example Amazon KDP, Etsy, or others);
  • any commercial decisions and outcomes.

We are a tool provider, not a rights holder or legal advisor.

5.4 AI disclaimer

Content is generated by artificial intelligence and may contain inaccuracies, artifacts, unexpected elements, or biases. You should review all outputs before using them.

5.5 Prohibited content

You may not use the Service to generate or distribute content that:

  • is illegal under Portuguese or EU law;
  • depicts minors in a sexual or exploitative context;
  • constitutes hate speech, incitement to violence, or harassment;
  • infringes third-party intellectual property or privacy rights;
  • impersonates real people without consent;
  • is intended for fraud, malware, or other harmful purposes.

We may suspend or terminate accounts that violate this section without refund.

6. No Affiliation with Third-Party Platforms

Coloring Books Maker is not affiliated with, endorsed by, or sponsored by Amazon, Kindle Direct Publishing (KDP), Etsy, or any other marketplace or publishing platform. Any references to such platforms are for informational purposes only. Their rules change independently and are your responsibility to follow.

7. No Guarantee of Commercial Success

We make no guarantee, representation, or warranty regarding sales, revenue, profits, search rankings, marketplace visibility, or any other commercial outcome from using content generated through the Service. Examples, case studies, or testimonials are illustrative and not a promise of results.

8. Acceptable Use

You agree not to:

  • reverse engineer, scrape, or abuse the Service or its APIs;
  • resell access to the Service or share your account;
  • use automated means to generate content beyond your plan's limits;
  • attempt to bypass credit limits, billing, or security measures.

9. Termination

You may delete your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the Service, or if required by law. On termination, your license to generated content already lawfully downloaded remains valid; access to the Service and remaining credits ends.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Nothing in these Terms limits rights that cannot be limited under mandatory consumer law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) EUR 100.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost sales, lost rankings, or loss of data, even if advised of the possibility.

Nothing in this section excludes liability for gross negligence, willful misconduct, or any liability that cannot be excluded under Portuguese or EU law.

12. Changes to the Terms

We may update these Terms at any time to reflect changes to the Service, legal requirements, or our business practices.

Minor changes (such as clarifications, typo fixes, updates to third-party provider names, or changes that do not materially affect your rights) take effect immediately upon posting, with an updated "Last updated" date.

Material changes (such as changes to pricing structure, refund policy, content licensing, or limitation of liability) will be communicated by email or in-app notice at least 30 days before they take effect. If you do not agree, you may cancel your subscription before the effective date and, where applicable under consumer law, request a pro-rata refund for the unused portion.

Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Portugal and applicable EU law. Disputes shall be submitted to the competent courts of Portugal, without prejudice to mandatory consumer protection rules that grant you the right to bring proceedings in your country of residence.
